the 2- month old daughter. >> it was wrong, pure murder. that's what it was. pure murder. >> did you know the guy in the car? >> no, we don't know why or who or anything. >> cherry recently moved to las vegas and lived in the plaza. the other two people killed were inside of a taxi. six people total were injured. kpix 5 reporter shows us that friends and family gathered at a memorial for kenny cherry who went by the stage name kenny clutch. >> it is hitting me hard because that was like my little brother. >> he lined the street along the border where kenny cherry grew up, gunned down in las vegas where he moved a few years ago. >> i think vegas was the best choice that he could have made. a lot of speed violence going

along here in las vegas. >> reporter: cherry's friends and family had encouraged him to go. his father left for las vegas to identify his son's body. friends and family said cherry came from a good friend that he briefly dabbled in criminal activity as a youngster, but at heart no troublemaker. he had been arrested for having marijuana and a gun back in 2007. but friends say he left that lifestyle behind years ago. >> the so called pimping is just an image. an image of music. >> what he was was a father to three children under four, including a newborn girl just two months old. >> it is unfortunate that i had to lose him like that because i feel like they stole him from me. new this morning brentwood union school district

superintendent has been placed on leave. this is because of the handling of an abusive teacher. the superintendent was put on leave yesterday. the school board also took disciplinary action against three other school employees. the woman behind the chili plot appeared in a san jose courtroom along with her son yesterday. she made up a story back in 2005 about finding a severed finger in a bowl of chili at a wendy's restaurant. now her son is being charged of a possession of a firearm and shooting himself in the foot. she allegedly lied to police about her son being shot by two men. police even came close to arresting someone. >> we interviewed this person and conducted various forensic testing as far as gunshot residue goes. we treated it like the real

deal. >> bail set at $150,000 each for her and her son. the high amount is because of their criminal histories. authorities in santa clara county busted an illegal pot growing operation. investigators found 70 pounds of processed marijuana and nearly 500 plants at a home on thursday. 32-year-old was arrested in that bust. the treat value of the pot seized is more than $600,000. more bay area headlines. a fifth person has been charged in connection of the murder of the south bay millionaire. alleged prostitute was in a courtroom yesterday accused of killing this man back in his mansion in november. three men are facing murder charges while another woman was being an accessory to murder. a gun buyback event happening today in east pal alto. they generated a real big response yesterday.

and today's buyback will be in the parking lot of the city hall from 10:00 this morning to 2:00. people can turn in guns anonymously with no questions asked. anyone getting a handgun could get $100, a rifle, $200, and if you turn in an assault weapon, $300. a police sergeant might have a date with destiny when he hopped on bart with bride-to- be. their married plans were nearly derailed when duty called. >> reporter: san jose police sergeant is more lover than fighter. sometimes he is both. >> just a regular guy happy to have a job and happy to have such a gorgeous partner. >> reporter: frederick and his fiance recently took bart to get their marriage license in san francisco. they paid $75 for a non- refundable appointment at city hall. witnesses say this woman jennifer davis grabbed another passenger's purse. in the back of the train she

was quickly surrounded by an angry mob. the suspect threw kicks and punches. someone tried to zap her with a taser on a day that was suppose to be about love, she whispered to her partner of ten years, don't get involved. >> and then he just disappeared like that, he was gone. >> reporter: it turned out that the 5-9 cop is a former college football star, olympic hopeful in boxing and track and trained extensively in mixed martial arts. frederick showed us what happened next. >> listen, i'm a police officer, and then i felt a little tug like that. and so then i take it like this. and i hold her like this. >> reporter: bart police met them at the next stop arresting her. the clock was ticking and there was no time to stay and fill out a police report. >> i showed them my identification, listen, we're trying to get married and i have an appointment, can we please go?

>> and they're like yeah, go ahead. >> reporter: they made the appointment with four minutes to spare. >> proud as i could be. absolutely amazing. i know what i have. i'm the lucky one. >> do you feel like you were meant to be on that train? >> i kind of do. i don't know why yet. maybe we'll find out later. all right it is 7:08 and we have breaking news right now from the east coast. the massachusetts institute of technology m.i.t. is on lockdown right now. a man carrying a long rifle and wearing body armor was spotted in a campus building. m.i.t. has said in a statement recently that several law enforcement agencies have responded. the school is advising students and workers to stay indoors and report suspicious activity to campus police. we'll keep you posted with more information that will come in on the lockdown at m.i.t. if you thought the fiscal cliff was bad, we are now dealing with a sequester. if you believe the warnings, next friday could be a

financial doom's day. $85 billion will fall out of the federal budget on march 1. automatic cuts, unless lawmakers can strike a deficit reduction deal among the dires that food inspectors would be furloughed, bathrooms would not be cleaned at national parks and fewer air traffic controllers on the job. >> flights to major cities like new york, chicago, san francisco and others could experience delays of up to 90 minutes during peak hours. >> but it might not be so bad. cuts are only a small percentage of the overall budget and the first cuts wouldn't happen until the end of and then workers would face two unpaid days off a month. the first push to go green. project open hand with big dreams for their online campaign. the benefits that could be expected. as a georgia boy you're intimidated by hollywood. >> a wounded warrior's brush

forget about waiting for summer in the outdoor swimming like 1,000 people are expected to dive into the san francisco bay today for the annual polar plunge. registration starts at 10:00 this morning. it will be used here for the aquatic park, going to the special olympics of northerncalifornia. what are we expecting? i'm feeling it'll be chilly. >> it'll be sunny, but the water temperature in the bay is in the 50s. i mean, that is a polar plunge and good luck to them. at least they'll get sunshine. it didn't amount to more than a few hundred, but we're waking up to wet areas. not a trace out there as all of this moves south with the weak little cold front pushing down to the bay area now. we'll look for clearing skies behind that. so in a bit we'll have mostly sunny skies around the bay area with the temperatures in the low 50s about an hour from now

and still clouds in the south bay. and the east bay here too. but aside from that, not too bad. 46 in concord right now. oakland has 50 degrees. it's 47 here in san francisco and santa rosa, 45 degrees. here's what we're expecting the sprinkles to end. sunny and chilly today. high and dry for the rest of february is the way it looks. in fact our next shot at rain does not look as if it will be coming in al the second week of march. and so we are dry for a while bay area. and in fact distinctly warm by next weekend. here's a little front that will be moving on through overnight. but everything else, they will head to the pacific northwest now, leaving us mostly high and dry. chilly today, northwesterly wind with kind of a chilly direction too. the numbers will not be too much. if you are heading out of the bay area, rain up there. down south, we'll get sunshine. your pinpoint forecast today, san francisco at 58 degrees. oakland's got 62. san jose at 59.

58 for livermore. your extended forecast will be going with nothing, but sunny side up as far as what i can see. if you look all the way to next weekend, we'll look for numbers urging about 70 degrees by friday. in the meantime sunshine, it's on the chillier side and we'll update this for you in half an hour. but we'll see what it ends up to. >> all right, thank you, brian. taking a cue from silicone valley start up. project open hand has launched an online campaign to help fund their greenhouse. purchasing manager of vanessa rogers, joining us live. thank you for being here this morning. >> thank you for having me. >> tell us about your group. >> yes, absolutely. we are a non-profit organization, located in the san francisco bay area. and we are committed to providing free nutritious meals and groceries to individuals with chronic illness as well as the elderly. >> okay, you're not just feeding them, you're feeding them good food. i guess what is the difference? >> yes, absolutely. it is nearly essential that the

food we prepare and provide is the highest quality possible that could help our clients who have compromised the new immune system to be healthy. >> what is the message behind the food that you're getting? it's kind of like a hug? >> yes, that's our slogan. and every meal is prepared with love and it is a really talented group that we have. >> you think that organic food is more expensive. you can find more ways around that growing on your own. >> yes, absolutely. the greenhouse is an innovative way for us to be able to grow our own fresh organic herbs late in the building. and that they have made a lot of strives to reduce our carbon footprints. i really feel as though you could not get more green than growing foods right in your own building. >> absolutely. must be a nice break to take a break too. >> yes, it would be fun for the volunteers and stuff and become

the primary caretaker. >> and so now the fundraising campaign, it is very difficult for charities right now to raise funds, especially with the economy for the past several years. but it will be hard to get new donors in the door. what are you doing now to try to fix that? >> we have an exciting campaign now that we have been looking at. so we have a video that we have made for $22,000 in order to build the greenhouse and to be able to grow the necessary herbs and greens. >> we're looking at the video right now here on your screen. how do you get people to watch this, especially on this day and age where they were not so interested in watching a cat video. >> yes, through the word of mouth, hopefully through individuals like yourself that will take a liking to that to see how important it is. and the more people, they will know it is very important. >> how is the fundraising going

skill. >> then we're going to serve it. oh, i dropped it off. very simple to make and delicious. just look at that. thank you, bella. awe, forget this. the year of the snake is upon us and 1 million people are expected to come out to china town's new year parade in san francisco tonight. builders are busy putting the finishing touches on their float this weekend. kicking off at 5:15 tonight running from market to second street to union square and to china town. san francisco is famous for hosting one of the biggest and best chinese celebrations in the world. midwest airports are back in operation after another massive snowstorm. passengers had to deal with major delays as runways were coated with up to six inches of snow. but how did they cope in st. louis?

his first morning of freedom...after nearly 7 years in prison. the bay area we're real glad to be here again. >> freedom for after nearly seven years in prison for a crime he didn't commit. the bay area students that helped free an innocent man. plus, the job layoffs, food shortages. all the scary predictions of the sequester doom's day less than a week from now. and a worldwide outage for another computing giant. what microsoft failed to do that triggered a lap in the cloud services. it is just about 7:30 on february 23. thanks for joining us. >> we had our own cloud problems. the clouds faced a little bit of rain, which wasn't suppose to happen. but mother nature just doesn't listen to the forecast. she does what she wants to do.

the high-def dopplered showed it is mostly high-def. first, the latest. >> yes, we are following developing news from the east coast. the massachusetts institute of technology m.i.t. is lifting their lockdown that had been on lockdown for the past couple of hours. now, officers, they say that the reports of the gunman that somebody had said they unfounded that school leader, receiving several reports of a man carrying a long rifle and wearing body armor in a campus building. the cambridge police tweeted about 25 minutes ago that officers have searched that building. they have found nothing. people in the area say police are removing the crime scene tape. again, a lockdown lifted at m.i.t. governors are in the nation's capitol right now, pressuring congress to stop the so-called sequester. governors from both parties are warning about the latest budget stalemate in congress are

threatening economic progress in their state. governor brown and members of the national governor's association, they will meet with president obama on monday. automatic across-the-board cuts are totaling about $85 million set to take effect in a week unless they could come to some sort of an agreement to stop or postpone those cuts in a weekly radio and web address. president obama took aim at therepublicans. >> unfortunately it appears that they have decided instead of compromising, instead of asking for anything, they would rather let these cuts fall on the middle class. and here's what that choice means. once these cuts take effect, thousands of teachers and educators will be laid off and tens of thousands of parents will need to scramble to find child care for their kids. air traffic controllers and airport security will see cutbacks, causing delays across the country. >> our republicans had a message of their own.

>> the fact is republicans in congress right now will provide the flexibility to make the necessary spending reductions and address our deficit and debt instead of going through the sequester. in fact house republicans have already passed two bills to replace the president's sequester. so the question is why wouldn't he work with us? and the answer is quite simply because he wants higher taxes. >> the cuts are getting closer and the warnings are more dire. kpix 5 linda yee with some of the places that you could feel the pinch. >> reporter: the inconvenience of airport security checks is about to get worse. thousands of security screeners could be furloughed. rate times at the airport possibly an extra hour. >> i've been coming another hour early. i'm actually mad about it. >> reporter: the school lunch programs will take a hit and thousands of teachers could lose their jobs.

federal dollars that pay for some homeless programs and subsidized housing, they will also evaporate. he is san francisco's point man on housing and homeless programs. >> it will be real fun for them to leverage what we're doing and losing a million of those dollars. having an additional, you know, 2366 people without the rental subsidy, having dozens of families becoming homeless because we don't have the to continue those family shelters. these are big problems for san francisco. >> reporter: they can only find part-time jobs. and like thousands of other families, they need help with their rent. a subsidy that he could not afford to lose. >> i need that income and that subs dare to help my family to my family. and my parents. >> reporter: millions of long- term unemployment would lose an average of $had 00 in benefits. they say that will put them one step closer to welfare as he will go to the state employment development office every day to look for work. >> and i need to get a job,

which will be competitive. people are coming out of the colleges and stuff like that and the economy, you know, it is really, really strong. >> reporter: republicans are accusing the white house of scare tactics. congress, they will need to make some tough budget choices when they are back in session next week. >> do you think that they are doing their job up here on the hill? >> no. they need to come to an agreement. >> it is political theater with a plot that doesn't have a happy ending for anyone. at san francisco international airport, linda yee, kpix 5. microsoft says that the online storage service has mostly recovered from the major outage. there are problems yesterday afternoon triggered by their failure to renew the security certificate. that outage affected a service here at cloud computing service that will be striking data from businesses all over the world. the customers may still encounter failures over the next day or so. best buy agreed to pay a penalty to establish a discount

program to several lawsuits. three district attorneys in southern california alleged that the best buy charged more than advertised on o the merchandise. they will pay nearly $900,000 and allow customers $3 off the lowest advertised price if they are overcharged at checkout. today people in san mateo county will increase food services. a day-long event. anyone interested is invited to join this. the goal is to kick off at 9:00 at stanford university. new this morning, the successful fight to maintain control of the police will be expense sieve while keeping control of the city. facing about $900,000 in legal bills. the judge ordered the city to

cover the cost of attorneys who wanted them to take over the department. an oakland man is waking up in home this morning after almost serving seven years behind bars for a crime he did not commit. >> i'm real blessed. i'm free again. it's been a long journey for me. >> he had been serving 25 years to life for a 2006 shooting that he had nothing to do with. a team of volunteer lawyers worked for years to prove his innocence and yesterday he was able to hug his mom for the first time in years. >> i'm 77 years old and i have never felt like this is my life. god is so good. he is awesome. >> reporter: the man investigators think is the actual shooter in that case is already in jail for unrelated crimes. imagine the logistics

determined or more capable. >> reporter: a high praise for a woman that may not have a medical degree, but whom these doctors say have done more to help patients around the world than what you can imagine. for 23 years laura has lead operation rainbow. a non-profit organization that provides free orthopedic surgery to needy children in underdeveloped countries. laura who speaks five languages volunteered to go as a translater with one of the first teams of doctors that travel from the bay area to guatemala in 1990. >> this one experience was so overwhelming. because in one operation they can change the life of a child. >> reporter: from that point on this wife and mother took it upon herself to handle all the details for the next mission. today, 100 missions later she's still at the helm. a typical operation rainbow

mission involves up to 30 volunteer surgeons, an seizologists, technicians, and nurses and beyond. now they will bring all their own supply, medical equipment and medicine. and so that when they are gone that week, they can see hundreds of patients and perform dozens of life changing surgeries. >> and they will come on foot, by horse. >> reporter: looking at photos of the past trip. it is clear that they have seen it all. but by far the biggest challenge these days are the bureaucracy that they will navigate from their tiny home office. >> they changed frequently. and we have had problems. and problems, they are a part of the package deal. >> reporter: dr. dave atkins has gone on 25 trips saying that the teaching aspect of these missions are critical. >> our goal is to create independence for nurses and technicians that they could care for their own people. >> when you see the need and the people who would never get the medical care that they will

sunny skies around the bay area and the numbers this morning are reflecting a 46 at concord. 47 degrees in san jose airport. and they will get that up in the pacific northwest. six plus inches of rain for them. but because of the storm track, it will be far enough north and it will miss us. while they get six plus days of rain, we'll get six plus days of sun. in fact, we'll be getting right into the bay area. so perhaps the beginning of the second week of march. and stay tuned on that anyway. they could change. in the meantime the cold front will push off on the bay area, leaving us with a few little sprinkles and slick streets to start off on saturday. but sunny and chilly for the rest of the day. and the forecast highs are a little cooler than what they should be for this time of the year. 60 in sunny vail and 59 at fremont. we're going to look at the numbers nudging at 60. with the northwesterly, things will feel a little brisk today,

but plenty of sunshine. in your e tended forecast, they will begin to warm it up as we have sunnyside up for the rest of the week with a little fog in the morning. other than that it will be sunny. as you look at the later half of the week for thursday and friday and by friday they will be nudging in the lower 70s in the bay area. so plenty of sunshine ahead, dry weather for the bay area and a nice sunday as well tomorrow. that's the weather now. on the doggy patrol, we'll go over to anne. >> all right, thank you, brian. we all know that adorable face that likes to peg for leftovers. but there are some steps that you should not end up putting in your pet's belly. and with the senior dog rescue, explaning why people should avoid giving their animals human food that is rich and fatty. >> i know the temptation is there to share a little bit of the ham or the roast beef. but the truth is a lot of the times those things, they can have some profound effects on dogs.

specifically a disease that we worry about here, which is usually triggered by something that is really rich, but not a normal part of their diet. the pancreas is a part of the system that helps digest things. and they produce that there to help with that process. when you give it something too rich, all of a sudden it gets out of whack and becomes pretty inflamed and it could be life threatening. quite a few dogs have come in and the owners will say i just wanted to give them a little taste of bacon and that's a little too rich, which could start pancreatic diseases or diarrhea. i don't recommend cooked bones because they seem to shatter and splinter easier. as far as hard uncooked bones, we worry about tooth fractures with those. and generally tell people that their better choices for dogs to chew on -- tell people that

there are better choices for dogs to chew on. avoid hard objects, but there are some that are less risky than raw bones. >> all right, now we are talking about chico. yes, he's a tiny dog from the senior dog rescue. 8 years old and a mini poodle. >> hi. >> he is just ridiculously cute. >> i know. >> tell us about chico. the family was not prepared to care for the dog and so we stepped in and we decided that we could find him a great home. >> yes, he is very sweet. when he first came to you, he was freaking out. >> yes, he's a little visually impaired. not horribly. still walking up and down the
